The state is obliged to protect the climate. The Federal Constitutional Court (BVerfG) derives from Article 20a of the Basic Law that the state must reduce greenhouse gas emissions in order to preserve the fundamental rights of future generations. The Federal Climate Protection Act implements the Paris climate protection goals, which are intended to limit global warming to well below two degrees, into German law and, in implementing this case law, defines a greenhouse gas reduction path by 2045.
