Three out of every four launches practiced derived from non-payment of rent, although they decreased by 3.1% year-on-year.

The total number of launches carried out in the first quarter of the year, 11,072, has remained very similar to those of a year ago, having experienced an increase of 1%, as reported on Monday by the General Council of the Judiciary (CGPJ). ).

Three out of every four releases (7,625) were the result of procedures derived from the Urban Leasing Law (LAU), while another 2,755 (24.9%) were derived from mortgage foreclosures. The remaining 692 were due to other causes.

Foreclosure-derived releases increased 8.1% from the same quarter in 2021; however, those derived from the Urban Leasing Law decreased by 3.1%. Those derived from other causes increased by 25.6%.

Catalonia -with 2,410, 21.8% of the national total- has been the Autonomous Community in which the most launches were practiced in the first quarter of 2022, followed by the Valencian Community, with 1,863; Andalusia, with 1,858; and Madrid, with 1,005.

The report also includes the number of releases requested from the common services of notifications and embargoes, although with the warning that this service does not exist in all the judicial districts, so the data allows to measure the evolution, but it does not indicate the absolute values . In addition, the fact that a launch is requested from the common service does not imply that the common service has executed it.

With these premises, the available data shows that the number of launches requested from common services in the first quarter of 2022 was 19,257, 6.2% more than in the same quarter of 2021. Of these, 9,013 ended with positive compliance, which represents a year-on-year increase of 0.9%.

It is more significant to relate the number of shots to the population. It is observed that the highest rate of releases derived from non-payment of rent per 100,000 inhabitants was that of the Balearic Islands (23.7), followed by those of the Canary Islands (22.5), Catalonia (21.9), the Valencian Community, ( 20.7) and Murcia (20.6). The territories with the lowest rate were Navarra (7.5), the Basque Country (8) and Extremadura (8.5).

In the first quarter of 2022, 740 verbal possession cases were filed for illegal occupation of homes, 6.3% less than the previous year, and 795 have been resolved. In Andalusia, the largest number of lawsuits (173) have been filed, which they represent 23.4% of the national total. They are followed by Catalonia (162); the Valencian Community, with 91, and Madrid, with 56.

Since the third quarter of 2018, statistical information has been available on oral possession judgments for illegal occupation of homes for cases in which the owners are natural persons, non-profit entities, or public entities that own social housing.

FORECLOSURES DECREASE 12%

During the first quarter of the year, 6,410 foreclosures have been filed, 12% less than in the first quarter of 2021.

The largest number has been in Andalusia (1,431), a figure that represents 22.3% of the national total; Catalonia follows, with 1,251; Valencian Community, with 1,042; and Madrid, with 741.

However, taking into account the number of foreclosures filed per 100,000 inhabitants, the Valencian Community stands out, with a rate of 20.5; Murcia, 19; and Andalusia, 16.5.

On its side, the number of contests presented in the first quarter of 2022 amounted to 5,312, which has meant an increase of 7.9% compared to the same period of 2021. The total number of contests maintains an upward trend since the third quarter of 2020.

Of the total insolvency proceedings filed, 2,812 corresponded to those filed by non-business individuals in the Courts of First Instance and First Instance and Instruction, which increased by 11.1% compared to the first quarter of 2021. The remaining 2,500 corresponded to those filed in the Commercial Courts, which increased by 4.4% compared to the previous year.

Of the 2,500 insolvency proceedings filed in the commercial courts, 1,080 correspond to natural business persons (29.5% more than a year ago), and 1,420 to legal entities (9% less than in the same quarter of 2021).

According to the report, Catalonia has been the community where the most bankruptcy proceedings were registered in the Commercial Courts: 846, which represents 33.8% of the total. Madrid followed, with 446; Valencian Community, with 311; and Andalusia, with 261.

Regarding insolvency proceedings filed by natural persons in the courts of first instance and first instance and instruction, the autonomous community with the largest number of them was also Catalonia, with 692, representing 24.6% of the national total. It was followed by Madrid, with 511; Valencian Community, with 401; and Andalusia, with 357.

The number of insolvencies declared between January 1 and March 31 of this year in the Commercial Courts was 1,490, with a year-on-year reduction of 2.4 percent. Added to this figure are the 992 contests declared and concluded under article 470.

In the same quarter, a total of 121 contests reached the agreement phase (9% more than a year ago), while 994 began the liquidation phase, 6.7% more than in the same quarter of 2021.

Regarding the files of article 169 TRLC, regarding the substantial modification of the working conditions of a collective nature (ERE), 110 files have been presented, 28.1% less than in the same quarter of the previous year.

In the first quarter of 2022, 30,126 dismissal claims were filed, 12.6% less than in the same quarter of 2021. Catalonia, with 6,287 (20.9% of the total), was the community in which filed more such claims. They are followed by Madrid, with 5,714; Andalusia, with 4,580, and the Valencian Community, with 3,309.

The number of lawsuits for quantity claims registered in the Social Courts, 31,990, was 6.9% lower than those filed in the first quarter of 2021. Of these, 5,949 were filed in Madrid (18.6% of the total); 5,280 in Andalusia and 3,831 in Catalonia.

The payment procedures filed were 239,972, which represents a year-on-year increase of 16.9%. The greatest use of this type of procedure has been in Catalonia, with 45,761, followed by Andalusia, with 39,802; Madrid, with 38,545; and the Valencian Community, with 26,985. The largest year-on-year increase has been in Catalonia, where it has reached 51.2%.

As explained by the CGPJ, the order for payment procedure is used to claim liquid monetary debts, determined, due and payable, and include the amounts owed for common expenses of communities of urban property owners.

In the first quarter of 2022, 24,989 cases of this nature have entered the specialized courts in floor clauses, which represents a year-on-year decrease of 30.8%. In addition, 36,128 have been resolved (3.6% less than a year ago), with 200,995 (8.2% more) being processed. 31,654 sentences have been issued, of which 97.9 percent are positive.
