After a three-year legal battle, former US President Donald Trump's tax returns may be referred to a congressional committee. The US Supreme Court on Tuesday rejected Trump's request for an injunction barring the Treasury Department from providing the Democrat-controlled Treasury and Budget Committee with six years of tax returns from Trump and some of his companies. The Supreme Court did not give a reason for this decision.

The Treasury Department refused to hand over the documents to the House Committee during Trump's tenure. President Joe Biden's administration said federal law clearly states that the committee has the right to review the tax returns of all taxpayers, including the president. Lower courts had already rejected Trump's argument that the committee was exceeding its powers and was only requesting the documents to be published.

If the Supreme Court had debated Trump's request longer, the tax documents might not have been handed over: When the new House of Representatives took office, the Republicans took over the majority in the chamber and thus also in the committee. They would probably have withdrawn the request for the documents to be handed over. Trump did not respond to a request for comment shortly after the court's decision.

The House Ways and Means committee and its chairman, Democrat Richard Neal of Massachusetts, first requested Trump's tax returns in 2019 as part of an investigation into the then-president's tax compliance. Federal law requires the Internal Revenue Service to provide tax returns for all US taxpayers to a handful of senior congressmen.

However, then Treasury Secretary Steven Mnuchin decided to withhold tax returns from Congress. Mnuchin argued he was able to withhold the documents because he concluded they were requested by Democrats for partisan reasons. This is how the lawsuit began.

After President Biden took office, the committee resubmitted its request, requesting Trump's tax returns and additional information for the 2015-2020 period. The White House took the position that the request was valid and that the Treasury Department had no choice but to comply. Trump then tried to stop the handover in court.

It was the second defeat before the Supreme Court in two months for the former president. In October, the Supreme Court refused to intervene in the litigation over the FBI search of Trump's Florida home, which found classified documents.
