In the trial for the attempted killing of a woman with a scarf, the Hamburg Regional Court sentenced the accused to four years in prison. The criminal court found the 53-year-old guilty of dangerous bodily harm on Thursday and also ordered him to be placed in an alcohol rehabilitation center.

According to the court, the Hamburg-born German had choked his friend's wife so hard that she was in acute danger of death. The charge was originally attempted murder.

The accused and the then 43-year-old had met half a year before the crime, explained the chair of the criminal division, Birgit Woitas. The woman often slept on the sofa with the ten-year-old man in the Wilhelmsburg district. She wanted a relationship, but he didn't want it.

They often argued, and the police even came to the apartment twice because of it. On January 20 of this year, they both drank several bottles of beer and wine. He was probably drunk with 2.5 per thousand, she with 1.5 per thousand.

After an argument, the cause of which the court could not determine, she lay on the sofa in the afternoon, but was awake. He put the scarf around her neck and pulled it tight for "maybe five to ten minutes" with more effort, said Woitas. The woman cried and said that she had a child.

The defendant then let her go and called the emergency services. The woman had temporarily lost consciousness and was bleeding from the mouth and nose. According to an expert, her life was in acute danger. After his arrest, the accused said, according to the judge: "The bitch should have died!"

He acted with intent to kill. The murder characteristic of insidiousness was not met because the woman was awake when she did it, explained Woitas. Then the accused resigned from his intention to kill and dialed the emergency number. The act must therefore be classified as dangerous bodily harm.

Due to his alcoholism, the defendant was reduced criminal responsibility. The court also recognized his confession and remorse as mitigating sentences. However, the 53-year-old has a considerable criminal record, even if these acts were a long time ago.

The public prosecutor's office had also moved away from the charge of attempted murder and had applied for five years in prison for dangerous bodily harm. In his plea, the defense attorney spoke of a minor case that should be punished with a maximum of three years. The verdict is not yet legally binding.
