The pattern for a declaratory judgment, had a long lead. In the end it had to go then, but quickly. The legislature had the Diesel-exhaust-gas scandal in the views. Claims for damaged VW customers, threatened the end of the year 2018 to become time-barred three years after the announcement of the exhaust gas scandal. The pattern for a declaratory judgment should, therefore, be introduced even earlier, so that associations can enforce collected in this way, the rights of VW customers.
