Two people could on Monday to leave the Court in Aarhus as free men. Both were indicted in a case of attempted murder during a bandeopgør in Aarhus. It informs Berit Ernst, who is the defense attorney for one of the defendants, a now 24-year-old man.
The two men were even deliberately påkørt of a car, where the now 24-year-old man sustained several serious injuries; among other things, several broken ribs and punctures of both lungs. The investigation showed that shortly before personpåkørslen had been shot against the car from a scooter
the Episode was preceded by 3. January 2017, at 19h45, at the junction of Haslemere Road and Herredsvej. Subsequently, the police found several bullet shells in the area.
the Court found it though not proven, that there was shots fired from the scooter, which was subsequently påkørt.
- They can't deny that there has been another scooter, and it has been from it, the shoots are given, says Berit Ernst.
She tells that there also was found a revolver close to the scooter, and it is demonstrably not the weapon that was used during the shooting. The court also came to the special 'bandeparagraf', which can increase the penalty by up to double, could not be used during the proceedings.
- even Though there was a conflict between the two groups, can not put for the reason that they could expect, that there would be a used firearm, explains Berit Ernst.
It emerged in court that the car was often used by members of the Brabrand-group, but the police have not found who sat behind the wheel, when the shoots fell.
By the same token, no one convicted of running the two men down, but it didn't change the satisfaction of the frifundne and the defence counsel:
- I'm happy to be able to take my cliff with out of the court, says Berit Ernst.
