In the complaint attaches Universal Music, among other things, the following to the reason for your request to the complaints Board for Domain names:

'the Domain is owned by Torben Hjalmar. After a conversation with Torben, we could both see that His name is spelled Hjalmar (with A) not Hjalmer (E). He already has a domain, which he uses for his business - hjalmarsmalerfirma.dk. He exclusively owns the domain as warehousing and want to make money on to sell it - contrary to the law of domænebrug', says among other things in the complaint.

In the complaint highlights the Universal Music also, that the domain 'hjalmer.dk' is silent and thus not to be used by Torben Hjalmar Christensen.

'By lookup on the domain name 'hjalmer.dk's the 20. February 2020, and again on 18. april 2020 made not a website with real content. By posting on the site the Internet Wayback Machine (archive.org) has the secretariat found that there was not archived websites associated with the domain name 'hjalmer.dk's, says in the complaint.

In the complaint, it appears that Torben Hjalmar Christensen does not have the answer in the case, and that the tribunal therefore only decide the matter on the basis of Universal Music complaint.

13. in may came the board with a decision in the case. They certain, that the registration of the domain name should be transferred to Universal Music, within four weeks, and that Hjalmer and Universal, hence, run with the 'victory' in the matter.

In the decision points out, the complaints Board for Domain names, however, that they can't see that the domain hjalmer.dk has been registered for warehousing and resale and thus is not in conflict with domæneloven on the point, as Universal Music otherwise had based their complaint in the first place, but that the use of 'hjalmer.dk's do not live up to the good domæneskik.

the Board's decision is among other things taken of, among other things, the following basis:

'the Domain name 'hjalmer.dk's are registered by the respondent, enkeltmandsvirksomheden 'Hjalmar’s painting company', the 20. april 2012. It is apparent from the information that the respondent does not currently use the domain name in any active way, and that the respondent apparently previously has not used the domain name in an active way. The respondent has, as mentioned, not responded to the secretariat's inquiries in the matter. The board of appeal therefore has no opportunity to assess whether the respondent has no real interest in the availability of the domain name 'hjalmer.dk's, sounds, among other things in the decision.

'There is not information in the case, that supports, that the respondent has a real interest in having the domain name 'hjalmer.dk'. In this context, the board then bevismæssigt for the reason that indklagedes interests may be handled at least as well by the use of the domain name 'hjalmarsmalerfirma.dk', which is also registered by the respondent and used to indklagedes website, sounds on.

Ekstra Bladet has been in touch with Torben Hjalmar Christensen, who don't want to comment in the case. He says, however, that he has changed the domain name, to which he has been required.

the Extra Leaf has also attempted to get a comment from Hjalmer, but his management say they have no further comments in connection with the case.
