At the end of march approached adelsätten Night and day a state herald at the national Archives and asked for advice. A member of the family association had paid attention to Vattenfall's new logo was strikingly similar to their same year when it came to color choice and color placement.
Vattenfall's new log consists of two semicircles, a yellow top and a blue at the bottom. Night and day the same year has the same colors and position but is to form a weapon.
In a response to the adelsätten write the state herald Henrik Klackenberg that the Waterfall has ”undoubtedly made an infringement of your rights through the adoption of a mark which is identical with the one of the most well-known coat-of-arms in american history”.
the parts held perception that övertrampet should not pass unnoticed but that it is not a case that the national Archives can operate when their field of activity covers only state and local government heraldry. The state proposes the family to get to the Waterfall and explain its position before taking other measures.
But according to Vattenfall, the company has not contacted by adelsätten Night and day.
"No, we have not been contacted by the family," says Markus Friberg.
– the Symbol, as well as the Night Time shield, consists of the Swedish flag colors. There are colors that many Swedish companies have chosen, for example IKEA. The shape, a circle, is also common. The circle with the colors is, therefore, not in itself distinctive.
– It is worth noting that a trademark provides protection in some countries, and in some of the products and/or tjänsteslag. A trademark registration protects the holder from infringement within the same type of operations, but typically provides no protection in other types of activities, " says Markus Friberg.
Night and day ”one of the country's oldest known still living noblemen and riksrådsätter of Swedish origin”. The clan's ancestor took Torpa parish in the current Ydre municipality.
